Antica famiglia di Montella (Principato Ultra), riconosciuta nobile con Regio Decreto 2 maggio 1920. Giulio (1671); Giuseppe (1712), ed Andrea (1782) furono esimi giuristi. Scipione Filippo (1821-1895) fu perseguitato politico nel 1848, ed in seguito, presidente di Cassazione, deputato dal 1861 al 1876 al Parlamento Nazionale e senatore del Regno. E' suo figlio Andrea avvocato generale militare on. (nato a Napoli 1846), spos. alla nobile Maria Immacolata Ruffo dei duchi di Bagnara. Lo stemma della famiglia Capone di Montella e Roma è cos' blasonato: Di argento alla testa di moro bendato di rosso. Motto della famiglia Capone: Si quid mea carmina possent - Durando vinco. Altro ramo. Antica e nobile famiglia Siciliana originaria di Messina ma propagata anche i Calabria, Basilicata e Puglia. Lo storico Galluppi la vuole originaria di Spagna e dice che godette nobiltà in Messina nei secoli XIV, XV e XVI. Lo stemma
